DESCRIPTION OF SERVICES 

On this site, we offer clothing, accessories, and other merchandise available for purchase at the prices listed for each product. All purchases are subject to the terms and conditions and on the specific product pages. 

GENERAL 

These terms set forth the terms and conditions that apply to the use of the site by the user. By using this site, the user agrees to comply with all of the terms and conditions hereof. The right to use the site is personal to the user and is not transferable to any other person or entity. The user shall be responsible for protecting the confidentiality of their password(s), if any. The user acknowledges that, although the Internet is often a secure environment, sometimes there are interruptions in service or events that are beyond the control of the company, and the company shall not be responsible for any data lost while transmitting information on the Internet. While it is the Company's objective to make the Site accessible 24 hours per day, 7 days a week, the site may be unavailable from time to time for any reason including, without limitation, routine maintenance. You understand and acknowledge that due to circumstances both within and outside of the control of the company. Access to the site may be interrupted, suspended, or terminated from time to time.

We may update these Terms from time to time. Substantial changes will be highlighted on our Site. You are encouraged to review these Terms periodically. A "substantial change" refers to any modification that materially affects your rights or responsibilities. 

Your use of the Site implies that you have read, understood, and accepted these Terms. When you use any current or future services of the Company or interact with any affiliated business, you agree to comply with the applicable guidelines and conditions. The Company does not provide warranties for products or services supplied by third-party vendors. For services or activities involving potential bodily harm, the Company disclaims any responsibility, and the end user is responsible for their own actions in utilizing such services. 

The Company is not liable for any damages arising from the use of third-party products or services. The end user assumes responsibility for any risks associated with these services or products.

All content, products, and services provided on this Site, or obtained from any linked websites, are provided "as is" without any warranties, either express or implied. This includes, but is not limited to, implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, security, or accuracy.

USER ACCOUNT AND MEMBERSHIP

MEMBERSHIP ELIGIBILITY 

Access to this site is available only to individuals who are legally capable of entering into binding contracts. This means that minors are not permitted to use the site. ONLINE PAYMENT SECURITY

  2. New credit card details are required when adding a new delivery address to protect against unauthorized access. 
  3. You can remove saved credit card details by editing addresses or unselecting 'REMEMBER MY PAYMENT DETAILS' during checkout. 

ADDING/REMOVING ITEMS TO/FROM EXISTING ORDER 

  1. Orders cannot be combined or modified once placed.  
  2. Cancel the existing order and place a new one if you wish to include or remove additional items. 

ORDER CONFIRMATION 

  1. After placing your order, you will receive a confirming receipt of your order via

2.Payment will be deducted at the time of placing the order. 

REVIEWS, COMMENTS AND FEEDBACK 

We may invite or allow users to provide feedback, comments, or suggestions on the site or via email/messages. However, these comments or feedback should not contradict these terms or violate any applicable laws. We reserve the right to delete or block any message or email that violates these terms or the law and may suspend or deny your access to the site in such cases. 

Any feedback, comments, or suggestions you share with us become the property of the company. You cannot claim intellectual property rights on these ideas, and the company reserves the right to use them exclusively. 

IMPORTANT INFORMATION  

  1. Order cut-off times are guidelines and do not account for payment authorisation delays. 
  2. We aim to dispatch orders within days during sales periods. Estimated delivery times start from dispatch. 
  3. We are not responsible for delays due to customs clearance or redirection requests. 
  4. Delivery may occur without a signature, aligning with international shipping standards. 
  5. Responsibility for the goods passes to you upon delivery or evidence of porch delivery if the recipient is a third party. 

OTHER IMPORTANT TERMS:  

Colours of Products 

While we strive to display the colours of our products as accurately as possible, we cannot guarantee that your monitor or screen will display the colours exactly as they appear. Variations in monitor settings, screen displays, and even minor differences in production batches can result in slight colour variations. You acknowledge that the actual colours of products may slightly differ from what you see on your screen at the time of ordering. No cancellations or returns will be accepted due to these minor colour variations. 

Custom colour changes may result in slight differences in the final product due to the printing and dyeing process, which is natural.  

Product and Pricing Information 

We aim to offer you the best possible prices on the products and services you purchase from us. However, we do not guarantee that our prices are the lowest available in your city, region, or area. Prices and availability of products may change without prior notice, and final prices are determined at our sole discretion according to our pricing policy. 

While we make every effort to provide accurate product and pricing information, errors may occur. If a product is listed at an incorrect price or with incorrect information due to a mistake, we may either contact you for further instructions or cancel your order and notify you of the cancellation. We reserve the right to modify the price and will reach out to you using the email address or phone number you provided during registration or when placing the order.  

Cancellation by Us 

There may be circumstances where we are unable to accept and must cancel certain orders. We reserve the right, at our sole discretion, to refuse or cancel any order for any reason. Some common reasons for order cancellations include, but are not limited to,  

  1. Limitations on available quantities 
  2. COD (Cash on Delivery) not being available at your location 
  3. Inaccuracies or errors in product or pricing information 
  4. Issues with the product itself  
  5. We may also require additional verification or information before accepting your order. 

This refund would be applicable only if we cancel the order due to the above reasons.   

Scenario 1:  

If we cancel an entire order after your payment has been processed, the amount will be refunded to your credit card, UPI or bank account details as provided by you within 5 to 7 working days after cancellation.  

Scenario 2:  

If a portion of your order is cancelled and your payment has already been processed, the amount which needs to be refunded will be refunded to your credit card, UPI or bank account details as provided by you within 5 to 7 working days after cancellation.  

Cancellations by the User 

If you wish to cancel your order you may cancel the order online (by logging into your account), or you may submit a cancellation request via email or WhatsApp. We reserve the right to accept or reject these requests.  

After the 24-hour period has passed, you will no longer be entitled to cancel the order or receive a refund. 

Scenario 1:  

Cancellation Request Received within 24 hours of placing the order:  

Generally, if we receive your cancellation request within 24 hours of placing the order, we will cancel the order and refund the entire amount. Please note that we cannot process cash refunds under any circumstances. However, Orders that have already been processed (including those where a cancellation request has been received within the first 24 hours) cannot be cancelled. 

We have the discretion to determine whether an order has been processed, and you agree not to dispute our decision. 

Scenario 2:  

Cancellation Request Received after 24 hours of placing the order:  

For all orders where the cancellation request is received after 24 hours from the time of order placement cannot be cancelled. 

The refunds against cancellation can be processed and you may request a chargeback only if: 

  1. You are eligible to cancel your order under above terms. 
  2. Despite being eligible and cancelling your order, we have not refunded your payment within the specified timeline. 

For cancellations made as per our terms, a cancellation charge of 5% of the order value (excluding any loyalty points or store credit used) will apply to cover payment gateway charges.

REFUNDS, RETURNS AND EXCHANGE POLICY 

Refunds 

Once Refund is approved as per our terms, the amount will be refunded to your credit card, UPI or bank account details as provided by you within 5 to 7 working days after cancellation.

Returns and Refund against Return 

RETURNS: 

Conditions for Return/Exchange  Request for returns or exchanges must be placed within 24 hours of delivery. Requests beyond this period will not be entertained. 

Request for return or exchange may be considered in the following scenarios:  

  1. If the Product is received in damaged condition. You must share images of the damaged product with our customer care team.  
  2. If the product received is different from the product ordered.  
  3. If there is a significant sizing issue. Standard sizing may vary by silhouette; however, we will not accept returns based on fitting issues. 
  4. The products must be unworn and must be in perfect condition. 
  5. Products must have all tags attached. 
  6. If the product is not classified as customized.  

6.1) If an exchange is processed, the item will be considered customized and will not be eligible for further exchange. 

6.2) All products customized/ altered for size or design are categorized as Customized products.    

6.3) All sizes which are XXL or above are categorized as Customized products. 

7. If the product gets damaged during transit from you to us; return and exchange shall not be processed.  

8. Accessories (including jewellery, clutches, wallets, bags, scarves, and belts), and any product marked as non-returnable or non-exchangeable at the time of purchase are not eligible.  

9. Discounted items or orders made using loyalty points or promotional gift vouchers cannot be  returned or exchanged. 

10. Products that are damaged, soiled, or returned without original labels may be rejected and returned to you. Items like belts, authenticity cards, dust bags, and tags should be included in the return/exchange. 

All exchanges, including changes in size, are subject to availability and our confirmation. 

REFUND AGAINST RETURN  

Refunds against Return are issued as store credit only and will be processed within 5-7 working days only in the following circumstances:  

  1. If the product hasn’t been delivered.  
  2. after we receive the returned product. 

Goods once sold can only be exchanged with another item or returned for store credit provided they meet our terms and conditions.  

Validity of Store Credit 

Store credits issued will be valid for 12 months from the date of issuance.  

Faulty Goods Items received in a damaged condition are considered faulty. Items damaged through normal wear and tear are not considered faulty. Faulty items can be exchanged for the same product in the same size, subject to availability, or repaired if possible. 

Custom Orders All custom-made orders are non-returnable, non-exchangeable, and non-refundable. 

Bulk Orders

  1. Orders of more than two products will be classified as bulk orders. For cash on delivery (COD) options, a 50% upfront payment is required. 
  2. If you prefer not to pay upfront for a bulk order, you will need to select a prepaid payment option. 

Shipping for Returns/Exchanges You will bear the shipping costs for returning or exchanging an item.  

Customization Policy 

  1. Basic Silhouette: The basic silhouette of a product cannot typically be changed. 
  2. Customization Options: Customization options include adding a plain sleeve, covering a sheer section, adjusting measurements, and altering colours. Please note that any embroidery will be considered a customization service and will incur additional charges. 
  3. Size Customization: Products in sizes XS and below, and XXL and above, are considered custom-made. 
  4. Early Delivery: Any order requiring early delivery will be considered custom-made. There might be some external charges that may apply for early delivery.  
  5. Availability and Charges: Customization is subject to availability and confirmation. Customization may be chargeable, and you will be informed of any charges within 3-4 working days after the customization details are shared, which may occur after the initial/full payment has been processed. There will be no full COD (Cash-On-Delivery) option available for customized products.  
  6. Right to Cancel: We reserve the right to cancel or withdraw customization services at any time without prior notice. 
  7. Fitting Issues: If there are fitting issues due to erroneous alterations or production, we will rectify them. However, if a product is altered/customized as per the provided measurements, we do not take responsibility for subsequent fitting issues. Additional alterations may be subject to charges and availability of resources. 
  8. Alterations on Discounted Merchandise: All alterations on discounted merchandise will be chargeable, regardless of the purchase date, product value, or type of alteration. Charges will be communicated within 3-4 working days after examining the product and receiving alteration details. 

BILLING 

  1. For Indian customers, price includes taxes (i.e. GST) 
  2. For international customers, prices exclude import duties. You are responsible for paying all import duties, customs fees, and local taxes upon delivery. For more details, contact us at merchant@nirraamyaa.com.

We may also charge taxes on shipping fees where applicable. 

For shipping outside India:  

  1. Orders over INR 25,000: No shipping charges will apply. 
  2. Orders under INR 25,000: Flat courier charges of 2000 for any international shipping below purchase of INR 25000.

(Note: Shipping charges may change if we update our policy to include shipping fees in the product price.) 

Cash on Delivery (COD) 

  1. Invoice Amount: We only collect the amount specified on the invoice. 
  2. Pin Code Restrictions: COD may not be available for all pin codes. 
  3. Order Verification: All COD orders will be verified via phone / WhatsApp before processing. 
  4. Verification Attempts: If we cannot reach you after 3 calls, the order may be cancelled. 
  5. Advance Payment: COD may not be available for all orders. We may require an advance payment of up to 50% of the invoice value for certain orders.  
  6. Accepted Currency: Only Indian currency is accepted, excluding denominations no longer in circulation. 

SPECIFIC OFFER TERMS 

Offer Restrictions 

  1. No two offers or discount codes can be combined.’ 
  2. Offers that require special codes or coupons do not apply to products eligible for discount on a second purchase. 

SEASONAL SALES 

  1. NIRRAAMYAA offers seasonal sales, which can be accessed from the SALE page linked on CLOTHING, BAGS, SHOES, and ACCESSORIES pages.  
  2. Availability and prices may vary compared to offline boutiques, and items may not be available late in the season. 

SALE PURCHASE TERMS (including End of Season Sales) 

  1. Applicability: Sales are applicable to “specific products” only and may not cover all items on the site. 
  2. In-Store vs. Online Discounts: Discounts on the site may not apply to in-store products. Sales staff will provide information for in-store items. 
  3. Returns/Exchanges: Products purchased during sales or with discounts cannot be exchanged or returned. 
  4. Custom Orders: Discounts do not apply to custom-tailored or early delivery orders. 
  5. Discount Changes: Any changes in discounts during or after the sale do not apply to past or future purchases. 
  6. COD Orders: COD orders require confirmation via phone or email within 48 to 72 hours after the order has been placed. Unconfirmed orders will be cancelled. 

15% Off Promotion 

  1. Coupons are valid for online orders only and do not apply to in-store purchases. 
  2. A code for 15% off will be sent via email with the order confirmation of your initial purchase. This code is applicable for use on your next purchase.  
  3. The code is valid for 6 months from the date of receipt. 
  4. The code cannot be combined with other offers. 
  5. The discount applies only to non-discounted products in your cart. 
  6. No minimum cart value is required to use the code. 

GIFT CARD & LOYALTY POINTS TERMS AND CONDITIONS 

Gift Card Terms and Conditions: 

  1. Validity: Gift cards are valid for 1 (one) year from the date of issue. Expired gift cards will not be extended or replaced. 
  2. Acceptance and Use: We reserve the right to reject any gift card if we suspect it has been 

2.1) used fraudulently; 

2.2) if the promo code is invalid; or  

2.3) if the cardholder is not the intended recipient. 

3.Redemption: Gift cards are non-transferable and cannot be: 

3.1) Redeemed for cash, gift vouchers, or credit notes. 

3.2) Refunded or substituted for other forms of value. 

4. Excess Amount: If the value of your purchase exceeds the value of the gift card, you must pay the remaining balance. 

5. Liability: We are not liable for any unauthorized or fraudulent use of gift cards. We assume that the person presenting the gift card is the intended beneficiary and will not verify the recipient. Our liability in connection with any gift card is limited to the card's value. 

6. Registration: To use a gift card, you must first register on our website. 

7. Additional Terms: These Gift Card Terms are in addition to our Terms of Use and Privacy Policy. 

8. Resale and Marketing: Resale of gift cards is prohibited. Gift cards may be used for personal or business gifts but not for  

8.1) marketing; 

8.2) advertising;  

8.3) promotional activities without prior approval; 

9. Compliance and Indemnity: By purchasing a gift card, you agree that its use will comply with these terms and all applicable laws. You also agree to defend and indemnify us against any claims or liabilities arising from your use of the gift card or violation of these terms. 

10. Lost or Stolen Cards: We will not replace lost or stolen gift cards.

Loyalty Points Terms and Conditions  

  1. Loyalty points are not credited on discounted products or if a coupon code is applied. 
  2. Loyalty points are valid for 6 months. 

PRIVACY AND PERSONAL INFORMATION 

  1. Your personal information is confidential and not rented or sold.  
  2. We collect necessary details for processing orders and may share them with credit agencies for verification. 

DELIVERY 

  1. Timeline: We strive to deliver products within the timeline provided but do not guarantee it. 
  2. Possible Delays: Delivery may be delayed due to factors such as: 

a. Bad weather 

b. Flight delays 

c. Political disruptions 

d. Unforeseen circumstances 

e. Production issues 

f. Operational/logistics issues 

3. Liability for Delays: We are not liable for delays caused by the above circumstances and you will not be entitled to any damages or compensation for delays. 

4. Notification: We may inform you of any expected delays at our discretion. 

5. Multiple Products: If you order multiple products, they may be delivered together or in instalments, depending on stock availability. Each delivery is considered a separate contract. 

6. Delivery Attempts: If you are unavailable on the delivery date, please inform our customer care team. Delivery attempts will be made up to 3 times before cancellation. 

7. Payment on Delivery: Products will not be handed over until payment is made. Returns or cancellations must be handled separately by our customer care team. 

8. . International Deliveries: Deliveries may be made without a signature per international shipping standards. Responsibility for the goods transfers to you upon delivery. If a third-party recipient is specified, evidence of delivery to the given address is considered a fulfilment of our obligation. Optional SMS delivery options may be offered by our delivery partner. Choosing a custom delivery option transfers all delivery responsibilities to the customer. 

9. Delivery Issues: We may be unable to deliver orders due to reasons including product unavailability, quality issues, or inaccuracies in product information. In such cases, you will not be entitled to damages or compensation. 

10. Domestic orders typically take 3-4 days from dispatch. 

11. International orders generally take a minimum of 7 days from dispatch, up to a maximum of 12 days. It may take longer in case of unforeseen circumstances. 

SHIPPING METHODS, TRACKING OF ORDERS AND RESTRICTIONS

Tracking: 

  1. Once your order is shipped, you will receive an email or some form of electronic communication with shipping details and a tracking number.  
  2. If you are registered, you can track your shipment by signing in and selecting "MY ACCOUNT" followed by "ORDER STATUS."  
  3. If you are not registered, consider signing up to track your orders. 

Restrictions: 

  1. Certain items may be restricted due to domestic and international regulations.  
  2. If an item cannot be shipped to your country, it will be identified during checkout, and you will need to remove it or provide an alternative shipping address.

PACKAGE INSURANCE 

  1. All items are insured against theft and accidental damage while in transit to the shipping address.  
  2. Once delivered, the insurance coverage ends.  
  3. If your package is damaged upon arrival, refuse the delivery or note the damage when signing. 

FRADULENT USE/TRANSACTIONS 

  1. Monitoring: We constantly monitor user accounts to prevent fraudulent activities. Users with more than one account or who engage in fraudulent transactions are subject to legal action. 
  2. Cost Recovery: We reserve the right to recover the cost of goods, collection charges, and legal fees from those who use the site fraudulently. 
  3. Legal Proceedings: We may initiate legal action against users for fraudulent use of the site or other unlawful acts. Upon detection of a fraudulent transaction, we may immediately delete the associated account and cancel all past and pending orders without liability. 
  4. No Liability for Refunds: We owe no liability for refunds in cases of fraudulent transactions. 
  5. Transaction Decline: We are not liable for any loss or damage resulting from the decline of authorization for a transaction due to a cardholder exceeding the pre-set limit agreed upon with the relevant bank.

  2. No Unauthorized Use: You must use your own credit card and provide valid details. We will not share your information with third parties except for fraud verification or as required by law.

WAIVER

FORCE MAJEURE 

We are not liable for any loss or failure to perform obligations under these Terms due to events beyond our reasonable control, including but not limited to:

  2. Outbreaks of contagious diseases 
  3. Government actions 
  4. Industrial disputes, strikes, labor unrest 
  5. Civil commotion, riots, terrorism, war 
  6. Poor environmental conditions 
  7. Mechanical breakdowns 
  8. Obstructions of public or private roads 

INTELLECTUAL PROPERTY RIGHTS 

  1. Liability: We are not liable for intellectual property infringements related to products listed on the Site unless the product is manufactured by our own brand.

ARBRITRATION  

  1. Dispute Resolution: Any dispute arising from your use of the Site or these terms will be referred to a sole arbitrator chosen by the company. 
  2. Location: Arbitration will be held in New Delhi. 
  3. Governing Law: The Arbitration & Conciliation Act, will govern the proceedings. 
  4. Language: Arbitration proceedings will be conducted in English. 

GOVERNING LAW 

These terms, the Privacy Policy, and any incorporated documents are governed by and construed in accordance with the laws of India. Any disputes shall be exclusively handled by the courts in New Delhi.
